GeeGuy, I'm with you on Scalia. Although I have conservative values, I lean libertarian when it comes to gov't implementing and enforcing those values. In my mind, it's the job of the church and educational organizations (not public education BTW) to inculcate morality in the people. I acknowledge, however, that all gov't decisions (legislation, rules, court decisions) have a moral basis and moral implications. Even so, the gov't should only regulate moral acts that directly infringe on the rights of others. It's the "your rights only go as far as the tip of my nose" concept of ordered liberty and the rule of law. Or, as the any classical liberal would say, "anything that's peaceful." Final point: I wouldn't base a system of morality on the "tip of my nose" concept" above. But, when it comes to human interaction in a free society, it works. Morality that goes beyond that point, again, should come from mediating institutions (the principle of subsidiarity http://www.acton.org/publicat/randl/article.php?id=200 ) like churches and civic organizations.
